Practice Areas.

Maritime, Marine Terminals + Transportation.

Representing international commercial ship owners, operators, charterers, and their insurers has been the core of Dave’s maritime practice since 2005. During this time, has handled a wide-array of matters ranging from major marine casualty investigations, oil spill responses, personal injury claims, and cargo claims, and commercial disputes. Dave also helps his internationally-based clients navigate California’s numerous environmental regulations governing invasive species introductions caused by ballast water discharges and commercial vessel-generated air pollution.

Construction + Engineering.

Dave’s construction practice focuses on high-stakes contractor licensing litigation. Dave represented one of the world’s largest construction, engineering, and project management companies in a series of contractor licensing lawsuits arising from his client’s work maintaining and improving the California state courthouses. Over $70 million was at stake in the litigation. Dave’s client first obtained a jury defense verdict awarding a California state agency that claimed his client was unlicensed nothing and awarding his client millions in unpaid fees. Dave’s same client then successfully defended the claims of its unlicensed, primary subcontractor for millions in unpaid fees through two bench trials.

Financial Services

Financial Services.

Dave defends financial services firms and individual securities brokers in matters involving claims for suitability, breach of fiduciary duty, fraud, negligence, breach of contract, failure to execute, churning, unauthorized trading, failure to supervise, and violation of federal and state securities laws before securities arbitration forums, such as FINRA (formerly NASD and NYSE), as well as in state and federal court. Dave has also successfully had customer complaints expunged from the records of financial advisors.
